Dear Senator Feinstein,

I have enclosed a letter that I have written to the Medical Director of Transamerica regarding the E&M guidelines which are unconsitutional as well as ridiculous and burdensome. I only discuss some of the problems in the physical examination portion. Imagine if the government looked at the legal records of lawyer's clients and required certain documentation regardless of relevance. You might say, "well if you take money from the government, you must play by government rules". I say, "well, let me bill patients unassigned, so that I do not take money from the government, but Transamerica cannot accommodate me in this, as I have explained to you so often, or let private contracting with Medicare patients be legal and encouraged, but to do this I have to forfeit seeing regular Medicare for 2 years and what about the Medicare patients that I am already following, do I have to dump them? and finally, let patients who are older than 65 years purchase private insurance.
