AAPS files motion in Limbaugh case

Together with the Florida Pain Initiative and the National Foundation for the Treatment of Pain, AAPS filed a motion for leave to file an amicus curiae brief on behalf of talk-show host Rush Limbaugh before the 4th District Court of Appeal in Florida. See Palm Beach Post, Jan. 21, 2004, www.palmbeachpost.com .

Limbaugh is being investigated for the crime known as “doctor shopping.” AAPS Executive Director Jane Orient, M.D., said this amounted to obtaining a second opinion, unbiased by knowledge of the first doctor’s opinion (Insight on the News).

The statute reads:

Florida Statute 893.13(7)(a)(8): "To withhold information from a practitioner from whom the person seeks to obtain a controlled substance or a prescription for a controlled substance that the person making the request has received a controlled substance or a prescription for a controlled substance of like therapeutic use from another practitioner within the previous 30 days."
