Cuban doctors are illegally treating Elian Gonzalez with the permission of the U.S Department of Justice, according to a complaint filed by the Association of American Physicians and Surgeons (AAPS).

Based on the government's own reports, several Cuban physicians, who are not licensed to practice medicine in this country, have been providing medical treatment to, and possibly medicating, Elian Gonzalez while he has been residing on private property in the United States since the end of April.

"As far as AAPS can discertain, these physicians are not licensed by any state in this country," said Jane M. Orient, M.D., AAPS Executive Directors. "Therefore, these physicians are illegally practicing medicine in this country, with the obvious nod of the federal government."

By Constitutional authority, licensure and regulation of doctors comes under the jurisdiction of the states. "And yet these Cuban doctors have been allowed, indeed, even encouraged, to practice medicine in the U.S. with the permission of the Executive Branch of the government," said Dr. Orient.

AAPS has filed an official complaint with the state of Maryland Board of Physician Quality Assurance, the state agency charged with licensing doctors. But now that Elian has been moved to Washington, Dr. Orient said that AAPS will file new charges with the D.C. Board of Medicine. AAPS will ask Members of Congress to intervene.

"The Department of Justice and the White House are asking the medical community to look the other way in the interest of this Administration's political interests," said Dr. Orient. "To allow the Department of Justice to usurp the constitutional power of the states is to set a bad precedent to allow any unlicensed physician to practice medicine. If this is allowed to go unpunished, all patients should be beware."

AAPS is a professional association of physicians in all specialties, dedicated since 1943 to the sanctity of the patient-physician relationship.
